This present, Terms and Conditions of São Rafael Galleries Platform, exclusively determines the contractual relations between any client that uses the platform/site http://www.saorafaelgalleries.com, and the company Sílvia A. R. Gomes. We believe that when a user visits the platform, interacting with it and making or not a purchase, he is automatically accepting our terms and conditions. If you do not agree with all the Terms and Conditions, please do not access the website or use our services.
Any new features or tools added to the current platform will also be subject to the aforementioned Terms and Conditions. We reserve the right to update, change or replace any part of these Terms and Conditions by posting updates and/or changes to our platform/website. It is your responsibility to check this page periodically and confirm any changes. Your continued use or access to the website implies acceptance of the Terms and Conditions.
By agreeing to these Terms and Conditions, you confirm that you are over the age of 18 or have given your consent to allow any of your minor dependents to use this website.
You may not use our products or information made available on the platform for any illegal or unauthorized purpose, nor violate any legal laws or intellectual property rights.
The prices of our products on the platform http://www.saorafaelgalleries.com or on other electronic media managed by São Rafael Galleries are subject to change without prior notice. We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without prior notice.
All products sold on the platform http://www.saorafaelgalleries.com are subject to return or exchange only in accordance with our Refund and cancellation Policy.
We have made every effort to display as accurately as possible the images and their dimensions and colors of the works made available on the http://www.galeriassaorafael.com platform, but we cannot guarantee that the images and their dimensions or colors displayed on computer monitors or mobile devices are accurate, so we advise you to always carefully read the description of the works/products and their dimensions and characteristics.
We may also, in the future, offer new services and resources through the São Rafael Galleries project and its platform http://www.saorafaelgalleries.com. These new features and services will also be subject to these Terms and Conditions.
By accepting these Terms and Conditions, you agree not to reproduce, duplicate, copy, sell, resell or exploit any part of the Service, use of the Service or access to the Service without express written authorization by the company responsible for the São Rafael Galleries project.
By accepting our Terms and Conditions, São Rafael Galleries and its business partners and artist partners are exempt from any claim arising from the violation of these Terms.
If any provision of our Terms and Conditions is found to be illegal, void or unenforceable, such provision shall be enforced to the fullest extent permitted by Law.
These Terms and Conditions are in force until terminated by you, who may do so at any time by not using our platform and, if you want, notifying us through the email firstname.lastname@example.org.
Any ambiguities in the interpretation of these Terms and Conditions should not be interpreted against the party who drafted them.
These Terms and Conditions will be governed and interpreted in accordance with the Portuguese legislation in force.
Refund and cancellation Policy
São Rafael Galleries platform and its managers reserve the right to refuse or cancel the service to anyone due to a stockout or any other reason, at any time. In case of cancellation of an order by São Rafael Galleries, the customer will be notified via email or telephone contact registered at the time of payment, and the amount paid will be refunded within a maximum period of 5 working days.
The Customer has the right to revoke/return a purchased product within a period of 14 days after its purchase from the invoice date if the product shows damage. For this, the customer must send us an email to email@example.com, explaining in detail the reason for the return, after which we will try together to find the best solution. Ultimately, and once the artwork subject to complaint has been collected from the client by São Rafael Galleries, we will reimburse the client through a voucher, valid for 1 year, for the value of the work/product purchased and respective costs return shipping, when applicable.
Once the product has been paid, São Rafael Galleries will immediately pack and ship it, which may take up to 10 working days maximum, so in the event of unjustified cancellation or incorrect or incomplete personal data on the part of the buyer customer the amount paid for the product is non-refundable.
If the same product is object of a purchase by several buying customers at the same time, being a single product, it will be sold to the first buyer who paid for the product. The order placed by the other buyer customers will be canceled, and the buyer customer will be notified via email of the order cancellation and the amount paid will be refunded.
How to buy at São Rafael Galleries
To purchase an artwork from São Rafael Galleries, you can do so in two ways: through the platform http://www.galeriassaorafael.com or through the email firstname.lastname@example.org.
Purchase through the platform http://www.saorafaelgalleries.com:
In order to guarantee the protection of the buyer’s data, currently all our payments are processed via Paypal, it is not mandatory to have a Paypal account. Paypal also offers the option to pay by debit or credit card.
To purchase a work or product > access the platform http://www.saorafaelgalleries.com > choose and select the artwork/product to purchase > add to cart.
Then go to the top of the page > Cart > proceed to pay.
On the checkout page, fill in your personal details (name, email, telephone number, delivery address and other additional information that you consider relevant) > select the payment method (Paypal or Bank Transfer) > confirm your order in Confirm Order.Finally, click Pay.
Upon completion of the purchase, you will receive an automatic email from Paypal confirming the transaction. If you have chosen to pay by Bank Transfer, print or save the transfer receipt as a pdf.
Attention: Before completing the payment, make sure all data is correct, including the email to which the invoice will be sent and the delivery address.
Note: If you choose to pay via Paypal, follow the steps indicated in the Paypal system. If you are not a Paypal customer, but want to pay with a debit or credit card (Visa, Master card, Discover and American Express) select the Paypal option but within the Paypal page click on Pay with debit or credit card or , if this option does not appear, click on checkout as a guest and follow the steps indicated in the system.

São Rafael Galleries declines any responsibility for any delay or impossibility of processing the order due to error or insufficient data communicated by the customer / buyer.

Alternatively, you can purchase the artwork/product via email. For this, send us an email to galeriassaorafael@gmail. with the title “Buy” and identification of the work/product you want to purchase (name of the work and its artist), as well as personal information for billing and shipping (name, mobile phone number, VAT number, complete shipping address) and proof of payment by bank transfer to NOVO BANCO SA IBAN PT50 0007 0000 0083 2770 7062 3.
In response, São Rafael Galleries will confirm the name, description, price and photograph of the artwork and proceeds to order/reserve the artwork or product.
The customer has a maximum period of 24 hours to send proof of payment, after which time the order is canceled.
Once the payment has been made by the client and confirmed by São Rafael Galleries, we issue an invoice to the client’s email and the artwork/product is packed and shipped, which may take up to 10 working days maximum, from the invoice date.
The promotional prices indicated on the website are valid until the 31st of December of the current year.
Shipping and delivery
São Rafael Galleries sell works of art with free shipping around the world. We ensure a personalized delivery to our customers made by an own team of São Rafael Galleries for deliveries in mainland Portugal, with exceptions where, due to the characteristics of the work, we consider that this is not justified. In these cases, and in the case of international shipments, deliveries are made via CTT/Express Mail or shipping company.
São Rafael Galleries are not responsible when the products are subject to customs services, declining responsibility for delivery times and/or any customs fees that are assigned to the customer when picking up the artwork/product. We advise you to consult the corresponding country’s customs services for more information.
COVID-19 Pandemic Restrictions
Within the scope of restrictions resulting from measures to combat pandemics, or in the event of a natural disaster, delays may occur in the dispatch or delivery of artworks by São Rafael Galleries. In the event of such an occurrence, that surpasses us, the customer will be informed immediately and will be able to choose to wait for delivery or to be refunded the amount paid, and the purchase will be cancelled. This type of refund will preferably be carried out immediately or within a maximum period of 3 working days.
Empório Aragão Collection Refund Policy and Shipping terms:
ORDERING AND SHIPMENT OF AN ARAGÃO COLLECTION PRODUCT
By selecting Empório Aragão Collection by São Rafael Galleries product you are not obligated to order. Products you wish to revisit later to order may be saved in your User account shopping cart. However, any products not ordered and instead saved in your shopping cart may be removed and/or deleted by São Rafael Galleries at any time, at its sole discretion. São Rafael Galleries bears no responsibility for any damages or losses attributed to the cancelation or removal of a Product from shopping cart that you have not ordered.
By placing an order through the São Rafael Galleries Platform, it will be considered that you have made a binding offer for the purchase of the particular product. In order to make such a purchase you will be required to submit payment information, which may include, without limitation: credit card information, debit card information, shipping address, billing address, full name and any other information São Rafael Galleries believe to be necessary to ensure all information necessary to ensure complete, accepted and processed payment for and shipment of the Product are proper.
Upon order of a Product and a complete transaction, you will be sent a confirmation email. This confirmation email is not an acceptance of your offer, but instead acknowledges São Rafael Galleries receipt of your order.
The Empório Aragão collection is a limited-edition by São Rafael Galleries created exclusively for you from the date of purchase, whereby São Rafael Galleries cannot guarantee the availability of a particular product you have ordered, despite your ability to submit an order. In the event an order has been submitted and paid for that is not available at the time of order, your Product will be placed on back-order until such time your order can be fulfilled. Printed, cut and handmade with upmost high quality and accuracy, all Aragão collection sales to you are final as set forth in Section Returns and All purchases final of this Agreement.
Once your order is processed through the São Rafael Galleries Platform and accepted by us for creation, you will receive an additional email informing you of the timeline in which your ordered Product will be ready for shipment (“Order Approval”). Depending on the complexity of the design selected and the amount of orders being processed, São Rafael Galleries may delay the creation and shipment of your ordered Product, in which case São Rafael Galleries will notify you of such delays and expected completion and shipment dates, respectively. São Rafael Galleries may include API tracking capabilities dependent on the type of shipment method. All products from Aragão collection include free international standard shipping (5-20 business days after processing). You may be provided with various options to ship your ordered Product. São Rafael Galleries bears no responsibility for any and all shipping carrier’s inability to ship your ordered Product. Further, São Rafael Galleries may, in its sole discretion, select a different shipping carrier on your behalf. You will bear the cost of any shipping costs and fees associated with your selected method of shipment or shipping carrier. São Rafael Galleries are not responsible for any miscalculations associated with any shipment method’s shipment timeline, whether provided to you through the use of such API tracking capabilities by São Rafael Galleries or any other means (including, but not limited to emails sent to you by São Rafael Galleries regarding your shipment timeline).
São Rafael Galleries cannot guarantee the adherence to any timeline and any timeline provided in any Order Approval is an estimation of the time it will take to complete and ship your ordered Product. São Rafael Galleries bears no responsibility for any damages or losses suffered as a result of the arrival or delay of arrival of your ordered Product.
São Rafael Galleries reserves the right, in its sole discretion, to reject any order for any reason at any time without advance notice to you.
Title to any Product on the São Rafael Galleries Platform shall remain with São Rafael Galleries until payment for such Product has been received and the Product has been placed with the shipping carrier. Thereafter, title and risk of loss for all Products ordered by you will pass to you, upon receipt of full payment and your ordered Product to the shipping carrier.
If the order has already been shipped it is your responsibility to contact the carrier to make necessary address updates (if applicable). Economy/Standard packages will not be able to change the address once it’s submitted. If the package is not able to be delivered successfully due to an address error, the customer may contact the carrier to arrange for delivery. Otherwise, the customer may risk the package being destroyed by the carrier. If the carrier will not take possession of the package due to incorrect or incomplete address, São Rafael Galleries will attempt to notify the customer via email. Customers have 14 days from the date of notification to respond with a verified address, additional fees may incur which will be due in advanced of reshipment. If no response is received within 14 days, São Rafael Galleries reserves the right to donate the merchandise and the order will not qualify for a refund. Refunds for the cost of shipping will only be given in the event the entire order qualifies for a refund as defined by our Empório Aragão Undelivered Package Policy.
Shipments may encounter custom duty fees. The fees are based on the destination and the regulations the country being shipped to. Different countries have import procedures which is determined by its custom’s law in the destination country, not São Rafael Galleries or the carrier.
Typically, the type of goods shipped and the value of that good are factors determining custom duties and taxes. Ultimately, the end customer will be responsible for paying the customs duty.
In the event your product is damaged or defective, please submit a Return Form within fourteen (14) days of delivery of the damaged or defective product and you must provide reasonable proof to us of such damage or defect. São Rafael Galleries will promptly review your correspondence in order to determine whether such damage or defect warrants a refund. São Rafael Galleries will inform you of its decision to approve or deny your request with an explanation of its decision in accordance with our Guarantee Policy.
Should the return be considered a defect, São Rafael Galleries reserves the right to investigate and conduct a thorough analysis of the defect, which may include sending the defective merchandise to São Rafael Galleries before a decision can be made. For defective products, São Rafael Galleries will offer a pre-paid shipping label and the merchandise must be shipped within seven (7) days of the issued pre-paid label date. Failure to send back the merchandise within seven (7) days of receiving the shipping label will disqualify the order from the review process and a refund will not be issued. São Rafael Galleries will not honor defect requests which are attributed to customers size concerns or design, such as plastic characteristics of the represented artwork. Our in-house Customer Experience team is fully equipped to process your return request quickly and efficiently so you spend less time waiting, and more time happy.
In the event your product is damaged or defective, please send us an email to email@example.com, intitled “Return Request” within fourteen (14) days of delivery of the damaged or defective product and you must provide reasonable proof to us of such damage or defect. São Rafael Galleries will promptly review your correspondence in order to determine whether such damage or defect warrants a refund. São Rafael Galleries will inform you of its decision to approve or deny your request with an explanation of its decision. For returns including defect requests, São Rafael Galleries communicate with the customers on shipping instructions should they want the return product sent to São Rafael Galleries Textil Partner fulfillment center. After 30 days, the returned product will then become São Rafael Galleries property for donation. Should any of the information listed above be incomplete or inaccurate, the return processing will be delayed.
Should the return be considered a defect, São Rafael Galleries reserves the right to investigate and conduct a thorough analysis of the defect, which may include sending the defective merchandise to São Rafael Galleries before a decision can be made. For defective products, São Rafael Galleries will offer a pre-paid shipping label and the merchandise must be shipped within seven (7) days of the issued pre-paid label date. Failure to send back the merchandise within seven (7) days of receiving the shipping label will disqualify the order from the review process and a refund will not be issued.
Before submitting for a return, please note the following:
– Packaging and product returning must be in original form. Dirty or worn clothing with missing tags/labels are not eligible. Washed clothing is not eligible for return.
– Review our sizing charts before orders are placed to ensure our sizing meets your product requirements for your customers.
ALL PURCHASES FINAL
Due to the artistic limited-edition nature of the Products you have ordered, all printed, cut and handmade exclusively for you, no cancellations are accepted after an order has been submitted. Your order shall be non-refundable and final. You acknowledge and agree that ordered Products produced by us for you are custom goods. In any scenario other than where a Product is defective or damaged pursuant to Section Returns of this Agreement, you have no right to cancel any order or return any Products and all orders, once accepted by São Rafael Galleries, are final.
If your package has not been received, Carriers will determine the package as ‘Undeliverable’ or ‘Lost in Transit’. If you have not received your package within the allotted time below, you may call the Carrier directly as the customer or notify São Rafael Galleries to investigate. If the Carrier lost the package in transit, we will file a claim on your behalf and issue a full-refund. São Rafael Galleries will not be able to refund orders if outside the policy dates below and reserve the right for an investigation period:
– Express/Premium- please notify within 14 days of the ship date.
The following exceptions apply:
– We are not able to file claims on packages marked as delivered by the Carrier. If your order is marked as delivered by the Carrier, and you do not have the package, please reach out to the carrier directly to file a claim. No refunds will be issued for orders marked as delivered. Delivery times include observed holidays or unexpected carrier delays.
– Errors caused by customer’s incomplete or insufficient address, São Rafael Galleries will not be able to refund orders. Packages are never guaranteed to be rerouted to São Rafael Galleries and may be disposed by the carrier which São Rafael Galleries are not at fault for.
US territories or an APO address shipping can range from 15-35 days or longer in some cases. Please contact firstname.lastname@example.org for status after 40 days. All Aragão Orders placed with Standard shipping.
We further inform you that, due to customs restrictions, the estimated delivery time may be longer than estimated to the Crimea, Lugansk and Donetsk regions in Ukraine, Russia, Belarus, Ecuador, Cuba, Iran, Syria and North Korea.
